1. About These Terms
These Terms & Conditions govern access to and use of icuathome.net (the “Website”) and the enquiry, assessment, rental, purchase, delivery, installation, collection, nursing, caregiver and related services offered under the brand ICU at Home.
ICU at Home is a brand of The Good Care People Innovations Private Limited, CIN: U87100KL2026PTC104080 (the “Company”, “we”, “us” or “our”). By using the Website, submitting an enquiry, requesting an assessment, placing an order, renting or purchasing equipment, or receiving a service from us, you agree to these Terms to the extent applicable to the relevant transaction.
Transaction-specific documents, including quotations, rental agreements, order confirmations, invoices, care plans and written service confirmations, may contain additional or more specific terms. Where there is a conflict, the transaction-specific document shall prevail for that transaction, subject to applicable law.
2. Website Information and Product Presentation
Information on the Website is intended to help customers understand our equipment and services. Product photographs, descriptions, functions, specifications, availability and prices are indicative unless expressly confirmed in writing at the time of order.
Unless a particular brand or model is expressly identified in a quotation or order confirmation, ICU at Home does not commit to supplying a specific manufacturer, brand or model. Equivalent equipment may be supplied based on clinical requirement, availability, compatibility and the agreed specifications.
3. Medical Equipment Rental
Rental equipment may include ICU beds, pressure-care mattresses, oxygen concentrators, respiratory equipment, patient monitors, mobility aids and other medical or supportive devices.
Unless otherwise agreed in writing, the applicable minimum rental period, rental charge, deposit, billing cycle, delivery charge and renewal or return notice period will be stated in the quotation or rental agreement. Rental charges are generally payable in advance, and the equipment remains the property of the Company throughout the rental period.
The customer is responsible for safe custody and appropriate use of rented equipment and must comply with the applicable rental agreement and operating instructions.
4. Security Deposit and Rental Return
Where a refundable security deposit is required, the amount and conditions will be communicated before confirmation. On return, the Company may inspect rented equipment for loss, damage, abnormal contamination, missing accessories, misuse or unauthorised alteration.
Reasonable costs arising from loss, damage, excessive cleaning, missing components or misuse may be deducted from the deposit. Normal wear and tear will not ordinarily be charged to the customer. Any remaining refundable balance will be processed in accordance with the applicable rental agreement.
5. Purchase of Equipment
For outright purchases, the applicable quotation or order confirmation will specify the product description, quantity, price, applicable tax, payment terms, delivery arrangements, warranty where applicable and any installation requirements.
Unless otherwise stated in writing, our standard commercial arrangement may require an advance payment on order confirmation and payment of the outstanding balance before or at delivery. Product brand, model, warranty period, delivery schedule and final availability are confirmed at the time of order placement.
6. Prices, GST and Payment
Prices displayed on the Website are indicative unless expressly stated otherwise. Applicable GST, transportation, loading, unloading, installation, additional labour, local handling or other location-specific charges may be charged separately where applicable and will be communicated before final confirmation wherever reasonably practicable.
A valid tax invoice will be issued in accordance with applicable GST requirements. Website content, enquiries and quotations are not themselves tax invoices.
7. Delivery, Installation and Collection
Delivery timelines depend on equipment availability, customer location, accessibility, payment confirmation and logistical conditions. Urgent or same-day delivery may be offered where operationally possible but is not guaranteed unless specifically confirmed in writing.
The customer must ensure reasonable access to the delivery location. Where stairs, restricted access, special handling or third-party or local labour is required, additional charges may apply. For rentals, collection will be arranged after the required return notice and settlement of applicable dues.
8. Inspection on Delivery
Customers should inspect purchased or rented equipment at the time of delivery. Any visible damage, shortage, incorrect equipment or apparent manufacturing defect should be reported promptly. Failure to identify a visible issue at delivery does not affect rights that cannot lawfully be excluded.
9. Equipment Use and Clinical Responsibility
Medical equipment must be used only for its intended purpose and according to the instructions supplied. Equipment requiring clinical prescription, settings or supervision — including oxygen therapy, CPAP, BiPAP/NIV and other respiratory-support devices — must be used in accordance with the treating physician’s prescription or other appropriately qualified clinical direction.
Customers must not independently alter prescribed pressures, oxygen flow rates, alarm limits or clinically configured settings unless instructed by an appropriately qualified healthcare professional. The Company supplies equipment and related support but does not guarantee a particular medical outcome.
10. Maintenance, Damage and Unauthorised Repair
For rented equipment, the Company is responsible for ordinary servicing and repairs arising from normal use, subject to the applicable agreement. The customer must not dismantle, modify, repair or permit unauthorised repair of rented equipment.
Damage caused by misuse, negligence, unauthorised modification, improper storage, accident, theft or failure to follow instructions may be charged to the customer.
11. Warranty on Purchased Products
Where a purchased product carries a manufacturer warranty, that warranty will apply according to the manufacturer’s applicable terms. Unless specifically covered, warranties ordinarily do not extend to consumables, disposable components, plastic parts, mattresses, normal wear and tear, misuse, negligence, accidental damage, unauthorised repair, improper installation or tampering.
We will reasonably assist customers with valid warranty claims for products supplied by us, subject to the applicable manufacturer or supplier process.
12. Returns, Replacement and Refunds
Purchased equipment is not automatically eligible for return merely because the customer changes their mind. Replacement, repair or another remedy may be considered where equipment has a verified manufacturing defect, does not conform to the confirmed order, or where applicable law otherwise requires a remedy.
Consumable, hygiene-sensitive or individually used medical items may be non-returnable where legally permissible. Nothing in these Terms excludes or restricts statutory consumer rights that cannot lawfully be waived.
13. Nursing, Caregiver and Assessment Services
Where ICU at Home facilitates nursing, caregiver or home-care support, allocation may depend on an assessment of the patient’s condition, care requirements, service duration, location, staff availability and the agreed care plan.
Care personnel must work within their qualifications, authorised scope of duties and the treating physician’s care plan where clinical care is involved. Home-care services do not replace emergency medical services or hospital treatment where clinically required.
14. Professional Standards of Care Personnel
Personnel deployed for home-care services are expected to act professionally, respectfully and compassionately; follow the agreed care plan and authorised scope of duties; maintain appropriate service records where required; and comply with applicable safety, confidentiality, infection-prevention and incident-reporting procedures.
Personnel may be employees, contractors or other appropriately authorised service professionals. The nature of their engagement with the Company does not reduce the professional standards expected while providing services to patients and families.
15. Safety and Infection Prevention
Home-care personnel are expected to follow appropriate infection-prevention practices, use suitable personal protective equipment where required, handle medical equipment safely and report material safety incidents through the Company’s established procedures.
Patients and families should disclose known infectious risks or relevant safety concerns within the home and should provide a reasonably safe environment for care personnel, technicians and delivery staff.
16. Cancellation and Service Changes
Cancellation, rescheduling, early return and refund conditions vary according to the product or service. The applicable quotation, rental agreement, care plan or written confirmation will govern transaction-specific cancellation terms.
Customers should notify us as early as reasonably possible when a delivery, pickup, rental continuation or care-service requirement changes.
17. Limitation of Liability
To the extent permitted by applicable law, the Company shall not be responsible for medical outcomes arising from the patient’s underlying condition; use of equipment contrary to medical advice or supplied instructions; unauthorised alterations to clinical settings; interruptions caused by electricity, telecommunications or events outside our reasonable control; or indirect or consequential losses not reasonably attributable to breach by the Company.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
18. Force Majeure
The Company shall not be responsible for delay or inability to perform caused by events beyond its reasonable control, including natural disasters, severe weather, epidemics or public-health emergencies, strikes, transportation disruption, government action, civil disturbance, major equipment-supply interruption or similar circumstances.
19. Intellectual Property
Website content, branding, graphics, photographs, layouts and written materials owned by or licensed to the Company may not be copied, commercially reproduced or distributed without prior permission, except where permitted by law.
20. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Subject to applicable consumer-protection and other mandatory laws, disputes arising from these Terms or transactions with the Company shall be subject to the jurisdiction of the competent courts at Ernakulam, Kerala.
21. Changes to These Terms
We may update these Terms to reflect changes in our services, business practices or applicable law. The current version will be published on the Website with an updated revision date.
